Privacy Policy
This Privacy Policy applies to the services offered by Radley Holdings Pty Ltd ACN 070 636 010 as trustee for the Radley Family Trust trading as Sweaty AF, ABN 65 822 416 634 (“Sweaty AF”).
Effective Date: 1 August 2020
This Privacy Policy may be amended, updated, reviewed or changed in Sweaty AF’s sole discretion. Any revision will be posted on Sweaty AF’s website and will show a new effective date.
Our Commitment
Sweaty AF complies with the Privacy Act 1988 (Cth) (as amended from time to time) and is committed to protecting your privacy and any Personal Information it collects. The purpose of this policy is to explain how Sweaty AF may collect, use, disclose and otherwise handle personal and Sensitive Information.

Providing Personal Information is an act of trust and it is taken seriously. Unless given consent to do otherwise, Sweaty AF will only collect and use Personal Information as set out below.
Examples of Personal Information that may be collected include your name, contact details (including phone and/or email address), date of birth, emergency contact details, employment details, payment details and Sensitive Information.
By submitting information to Sweaty AF or by otherwise accessing or using websites or social media platforms operated by Sweaty AF, you consent to Sweaty AF using and disclosing your Personal Information in the ways described in this Privacy Policy.
Booking our Services
Our main service is the provision of group fitness classes in a studio environment. We may on occasion offer other services, or ancillary products to you. The information we collect from you is to allow us to provide these services and products to you.
We use a software called ‘Glofox’ to facilitate the services we provide, including booking into a class. You agree to the Privacy Policy of Glofox, which may be amended from time to time, in relation to any Personal Information you provide. Glofox will share the Personal Information with us, which we will then use in accordance with this Privacy Policy. Email Communication and “Contact Us” Section of the Sweaty AF website
We use Mailchimp for receiving and responding to your queries submitted by you via the “Contact Us” section of our website and some email communication which may be sent to you from time to time. You agree to the Privacy Policy of Mailchimp, which may be amended from time to time, in relation to any Personal Information you provide. Mailchimp will share the Personal Information with us, which we will then use in accordance with this Privacy Policy. Payment Processing
We use Stripe Payment Australia Pty Ltd for the processing of our payments. You agree to the Privacy Policy of Stripe, which may be amended from time to time, in relation to the processing of payments. A copy of Stripe’s Privacy Policy can be accessed here: https://stripe.com/au/privacy
What is Personal Information?
The types of Personal Information Sweaty AF may collect includes, but is not limited to, the following: • full name • contact details • age/date of birth • occupation • employment/study details • emergency contact details • payment information (for example debit/credit card details or bank account details) • general fitness information such as how often you want to exercise • payment history • public accessible bankruptcy information • your image, if you are photographed at one of our venues. We also collect Sensitive Information, which is further described later in this policy.
The Collection of Personal Information
Sweaty AF will only collect your Personal Information (including Sensitive Information, where applicable) by lawful and fair means including directly from you or authorised third parties. Sweaty AF may also use the information for a variety of reasons, such as for marketing to you, or for any other purpose permitted under the Privacy Act 1988 (Cth).
Personal Information is collected directly from you when a service or product is purchased online or in person. We request this information to provide the requested service or product.
Personal Information is also collected when individuals provide business cards or other documentation to us containing such Personal Information, including completion of a Membership Agreement and a Health Questionnaire.
Sweaty AF may collect information (including Sensitive Information) from third parties including but not limited to the following:
• a trainer
• any of our staff
• Glofox (our software provider)
• market researchers and direct marketing providers
• parents or guardians of underage clients
• an existing client
• a government entity such as the ATO or ASIC, and
• any public sources.
You do not have to provide Personal Information (i.e. you may remain anonymous in your dealings with us), however, failure to do so may result in Sweaty AF being unable to provide services or products to you.
The Collection of Sensitive Information
For the purposes of this Privacy Policy, Sensitive Information is a subset of Personal Information. The types of Sensitive Information generally collected by us includes information relating to physical and mental health that is necessary to properly advise customers about fitness training.
The types of health-related information include medical history, whether individuals are using medication, smoke or are pregnant and other health related information. We will obtain specific consent in circumstances where it is necessary to collect Sensitive Information.
We may also keep a copy of your identification (for example, a driver’s licence) on file. This is predominantly required so we can confirm your identity.
Such information will not be used or disclosed for any other purposes without consent, except in exceptional cases when disclosure may be required by law or is necessary to protect the rights or property of Sweaty AF, or any member of the public, or to lessen a serious threat to a person's health or safety.
Updating your Personal and Sensitive Information
You are required to ensure that your Personal and Sensitive Information is current. Please email us at privacy@sweatyaf.com.au to update any of the information we hold on record for you.
CCTV Cameras and Surveillance
For the safety and security of staff and members, Sweaty AF may use CCTV cameras to take images or videos within the club or within the perimeter of the club.
Only authorised staff can access these recordings.
Sweaty AF may disclose images or videos of a specific event to Victoria Police, or subject to a legal requirement such as a search warrant, or otherwise in accordance with this Privacy Policy.
Tracking Technologies
No Personal Information is collected by Sweaty AF when individuals visit our website, unless they chose to provide it to us (for example, by sending us emails through our website or signing up to our products or services).
However, we may collect certain data that does not identify individuals (sometimes called “web log information”) when they visit certain pages (such as the type of browser and operating system they have).
We may also use “cookies” which are small files that are stored on a computer and that manage the security and navigation process of the site. Users can choose to block these cookies but some portions of the site may not function correctly if they do. This type of data is collected for statistical purposes only, and while cookies will identify a computer, they are unlikely to identify users personally.
Use & Disclosure of Personal Information
Sweaty AF will use Personal Information for the following primary purposes:
• To render services and provide products to a client;
• To provide information about products, services and/or special offers to a client;
• To obtain opinions or comments about products and/or services from a client;
• To record statistical data for marketing analysis from a client.
Sweaty AF may use other service providers to assist in providing its services. The third party providers may have access to your Personal Information that is needed for them to perform their specific function. They are prohibited from using that information for other purposes.
Our Marketing Efforts
Sweaty AF may communicate with its members including sending marketing or promotional material with prior consent. Should you wish to cease receiving any such communication, you may request your removal by contacting Sweaty AF by email to: privacy@sweatyaf.com.au
Your Access and Correction to Personal Information
The access to Personal Information that Sweaty AF holds can be obtained on request. A request to access Personal Information should be made in writing by email to: privacy@sweatyaf.com.au
You may amend or delete any Personal Information held by Sweaty AF. All reasonable steps will be taken to delete the information requested, except where retention is required by law. Deletion of information may mean that Sweaty AF is no longer able to provide products or services to you.
Sweaty AF may refuse your request to access Personal Information in its sole discretion provided it has a reasonable reason to do so.
The Storage of Data
Sweaty AF will take all reasonable steps to keep secure information that it stores. Data may be made up of digital and hardcopy documents.
Sweaty AF will ensure that digital information will be stored on secure servers and will be password protected. Hardcopy information will be maintained in locked areas.
All data we store will be maintained on servers located in Australia.
Cross-border Disclosure of Personal Information
Our software provider may store information in servers located in other areas (outside of Australia). You should refer to Glofox’s Terms and Conditions in this regard. We may need to disclose Personal Information to Glofox as part of providing you with our services. In doing so, your data may be transferred and stored in servers overseas.
Marketing by Us
We may on occasion send you marketing material relating to our products and services. You opt in to receive these when signing up for our services. However, you can opt out at any time by either clicking the appropriate ‘unsubscribe’ button on the email you receive, or by emailing us directly at privacy@sweatyaf.com.au
Third-party Sites
If Sweaty AF provides links to any other websites, you acknowledge that Sweaty AF does not have control of these websites and is not responsible for the management of your information from your use of those websites. You should refer to each of their corresponding Terms and Conditions and Privacy Policy to understand how that third party will deal with your information.
Sweaty AF takes Privacy very seriously
If at any time you have any queries, concerns or suggestions for us, or would like to make a complaint relating to the steps Sweaty AF has taken to protect your information, we encourage you to contact us. We take all submissions seriously and will investigate any complaints received and do our best to resolve them as soon as possible.
